E-Verify Rules Delayed Again

Synopsis: On July 8, 2009, the Department of Homeland Security announced that new rules amending the Federal Acquisition Regulation (FAR) with respect to the use of the government’s E-Verify system will go into effect as currently planned on September 8, 2009. The new regulations will require government contractors and subcontractors to use the E-Verify system to verify that employees working on government contracts are legally allowed to work in the United States. Additionally, affected contractors will have to verify that all new hires working in the United States, whether or not assigned to government contracts, are eligible to work under applicable immigration laws. (Certain limited exceptions exist, for example, for employees whose eligibility was previously verified through E-Verify or employees who hold an active security clearance.)
