Cordatis successfully defends challenge to security clearance based allegations of criminal conduct

Bill Savarino and Rhina Cardenal saved another clearance (and likely a career) by convincing the Defense Counterintelligence and Security Agency Consolidated Adjudication Services in Fort Mead, MD (DCSA CAS) to withdraw its Letter of Intent to Revoke Eligibility for Access to Classified Information (LOI). The case involved serious allegations of Criminal Conduct under Guideline J.

Our client is a civilian employee on a military base, and DCSA CAS suspended his clearance pending its decision on revocation. In a complicated factual scenario, our client’s girlfriend–who also possessed a high-level clearance and was his superior at work–accused him of serious crimes, including rape, first-degree assault, and burglary. Based on these accusations, our client was arrested and incarcerated pending trial. Bill and Rhina prepared a detailed and explicit refutation of the allegations supported by 26 exhibits that included 17 declarations from people (mostly women) who knew the individual and some who also knew the accuser. Based on this, DCSA CAS withdrew the LOI and lifted the suspension of his clearance. And just as importantly, the prosecutor withdrew virtually all of the criminal charges.
